On January 20, 2011, the D.C. Circuit Court of Appeals rejected the U.S. Environmental Protection Agency’s (EPA) request to extend the court-ordered deadline to issue the final National Emission Standards for Hazardous Air Pollutants for Industrial, Commercial, and Institutional Boilers and Process Heaters (Boiler MACT) and the New Source Performance Standards for Commercial and Industrial Solid Waste Incineration Units (CISWI NSPS). On September 3, 2010, the State of Indiana, joined by 11 other states, filed a brief with the U.S. Supreme Court asking it to overturn a recent decision by a federal appeals court which held that five large electric utility companies could be liable for their greenhouse gas emissions.
